Terms of Use

Article 1 – Purpose
These Terms of Use govern the conditions and procedures for using the scuba diving courses, dive tours, travel products, and other related services (hereinafter “Services”) provided through nbdivers.com (hereinafter “Site”) operated by NB DIVERS Co., Ltd. (hereinafter “Company”).
Article 2 – Validity and Amendment
① These Terms take effect upon publication on the Site.
② The Company may amend these Terms within the scope permitted by applicable laws, with notice provided at least 7 days in advance (30 days for important matters) through the Site.
③ Users who disagree with amended Terms may discontinue use of the Services and terminate their agreement.
Article 3 – Formation of Service Agreement
① A service agreement is formed when the user completes a reservation/payment application and the Company accepts it.
② The Company may refuse or subsequently cancel applications in the following cases:
- False information was provided
- Failure to meet health requirements for diving participation
- Other circumstances that prevent service provision
Article 4 – Fees and Payment
① Service fees are based on the amounts published on the Site. All fees include VAT.
② Payment methods: Credit/debit cards, bank transfer, wire transfer (Hana Bank 562-910026-40704, Account Holder: NB DIVERS Co., Ltd.)
③ For foreign customers, payment amounts are in Korean Won (KRW). The Company is not responsible for differences due to exchange rate fluctuations.
Article 5 – Cancellation and Refunds
① Cancellations and refunds follow the Act on Consumer Protection in Electronic Commerce and the Consumer Dispute Resolution Standards (FTC Notice).
② Course fees are calculated by dividing one full day of the assigned instructor’s schedule among the divers training together. For open water training the fee also covers transport and local diving costs. A course made up of several dates is priced date by date, so cancellations and changes are settled on the basis of the date affected. The standards in this Article apply identically to pool training and open water training.
③ Cancellation and change standards are as follows.

This covers the instructor fee (₩300,000 per instructor day ÷ number of participants) and transport. The only refundable item is your own diving cost; the diving cost for your instructor, transport, extra instructor time, and every other local cost are non-refundable. Any remaining dates that have not yet run are refunded in full. The ₩100,000 deposit is applied to this amount. To run the cancelled date later, you pay only the cost of that date |

④ The cancellation fee in Paragraph ③ is a pre-agreed measure of loss for the instructor holding that day and turning away other divers. Part of it is paid to the assigned instructor.
⑤ If the group size drops within 7 days of the course start, the diver who cancels settles their own share under Paragraph ③, so no additional cost falls on the remaining divers and the course runs as scheduled.
⑥ Among local costs, only your own diving cost for dives never made and unused pool admission are refundable. The instructor fee, the diving cost for your instructor, transport, extra instructor time, and every other local cost already committed to hold the date are not refundable, because the instructor still enters the water and the vehicle still runs whether or not you are there. For example, if you book a one-day open water session and cancel within 7 days, only your own diving cost is returned; the course fee, the instructor diving cost, transport, and the rest are not.
⑦ One-day programs such as Discover Scuba Diving and Diver Essentials follow the same standards as Paragraph ③.
⑧ If severe weather, natural disaster, or other force majeure not attributable to the user makes the course impossible to run, a full refund is given even on the day before or the day of. The user may choose a refund or a new date.
⑨ Once a PADI eLearning account code is issued, the agreement for those materials is between PADI and the user. Refunds follow PADI policy and the Company cannot process or refund them. Printed materials and course resources are non-refundable once received.
⑩ Refunds are processed through the original payment method and may take 3–5 business days.
⑪ The standards in this Article match the refund policy on the course fees page. Where the two differ, whichever is more favorable to the user applies.
Article 6 – Safety and Health Obligations
① Users must honestly complete the PADI standard Medical Statement before diving participation.
② Participation is restricted for users who are intoxicated or have a physician’s restriction on diving.
③ The Company is not responsible for accidents caused by false health information provided by the user.
Article 7 – Company Obligations
① The Company ensures courses are conducted by qualified instructors in accordance with PADI standards.
② The Company safely manages and maintains equipment required for service provision.
③ The Company protects users’ personal information in accordance with the Privacy Policy.
Article 8 – User Obligations
Users must not:
- Make reservations using another person’s information
- Violate an instructor’s safety instructions or PADI diving standards
- Intentionally damage or remove Company-owned equipment without authorization
- Engage in other acts that violate applicable laws or public order and morals
Article 9 – Limitation of Liability
① The Company is exempt from liability when unable to provide services due to force majeure (natural disasters, war, severe weather, etc.).
② The Company is not responsible for damages caused by the user’s own fault.
③ Diving involves inherent risks, and users acknowledge this fully before using the Services.
Article 10 – Dispute Resolution and Governing Law
① In the event of a dispute, the Company and user will negotiate in good faith for an amicable resolution.
② If negotiation fails, either party may apply for dispute mediation through the Korea Consumer Agency or Fair Trade Commission.
③ These Terms are governed by the laws of the Republic of Korea. The court of jurisdiction shall be the court with jurisdiction over the Company’s registered location.

Addendum: These Terms take effect from January 1, 2025. The amended Article 5 applies to agreements entered into on or after August 24, 2026; agreements entered into before that date follow the previous version.
